· User means every party who accesses and/or uses Dian Solar website.
No Warranties and Representation
Dian Solar does not make any representation or give any warranty (whether express or implied) as to the completeness or accuracy of any information or any other information provided or contained in Dian Solar website. The User should independently and duly verify such information before the User acts upon it. Limitation of Liability

· negligence and/or loss incurred by the User in relation to the access or use, or inability to access or use Dian Solar website
· virus or any other dangerous software obtained by accessing or connecting to Dian Solar website
· interruption, bugs, delays, or any errors in Dian Solar website
· any hacking actions done by third party to the User’s account or Dian Solar website
· damage to the User’s hardware because of the use of Dian Solar website
· other matters related to the use of Dian Solar website
Modifications
Dian Solar reserves the right to change any part of Dian Solar website at any time at its absolute and sole discretion without prior notice. Changes may be made to any material from time to time.
Indemnity
The User hereby agrees to indemnify and/or compensate Dian Solar (including its affiliates, subsidiaries, management, and employees) from any claims or charges for damages and losses (actual and implied) arising from User’s violation of the prevailing laws and regulations and/or any provisions of this Terms of Use, including but not limited to legal fees, administrative fines, and rights protection costs. Therefore, the User agrees to release any legal protection (stipulated in applicable rules and regulations) that will limit the scope of this indemnity.
Dian Solar failure to exercise or any delay in exercising its rights under this Terms of Use does not constitute a waiver of these rights, and the sole or partial exercise of any of its rights under this Terms of Use does not hinder the exercise of any other rights. Dian Solar has the right to require User to continue to perform their obligations and bear the corresponding liability for breach of contract at any time.
Dian Solar’ Intellectual Property
The intellectual property in and to the Dian Solar website and materials are owned, licensed to or controlled by Dian Solar, Dian Solar’ licensors or service providers. Dian Solar reserves the right to enforce the right of the intellectual property to the fullest extent of the law.
No part or parts of the Dian Solar website may be reproduced, reverse engineered, decompiled, disassembled, separated, altered, distributed, republished, displayed, broadcast, hyperlinked, mirrored, framed, transferred or transmitted in any manner or by any means or stored in an information retrieval system or installed on any server, system or equipment without Dian Solar’ prior written permission.
Applicable Law and Jurisdiction
Dian Solar makes no representation that information on Dian Solar website is appropriate or available for use outside of the Republic of Indonesia. Any claims relating to, and the use of Dian Solar website and the materials contained herein is governed by the laws of the Republic of Indonesia with the Courts of Indonesia having exclusive jurisdiction.

This Terms of Use shall constitute the entire agreement between User and Dian Solar relating to the subject matter hereof and supersedes and replaces in full all prior understandings, communications and agreements with respect to the subject matter hereof.
